Re: Approve Amendment to MnDOT Joint Powers Agreement, Hwy 61 Wall Repair Design
Enclosed for Council approval is an amendment to the Joint Powers Agreement between
MnDOT and the City for the Vermillion Street Historic Retaining Walls project. The joint
powers agreement is a joint contract with the City and MnDOT contracting with MacDonald &
Mack Architects to provide the plans, specifications, and some project management work.
After receiving bids in April and reviewing the proposals from prospective contractors, MnDOT
made the decision to re-bid the project after. revisions to the plans and specifications could be
made to further strengthen the contract in the favor of MnDOT and the City.
Because this decision was at the discretion of MnDOT, MnDOT has agreed to pick up the
additional consultant expenses related to the plan and specification revision work. However, as
the City is a parry to the Joint Powers Agreement, approval of the City is also necessary to
execute the amendment.
Originally, the City's share of the design expense was not to exceed $60,600, with the remainder
of the $159,000 total design cost being contributed by MnDOT. The amended total contract
amount is now $168,800, although the amendment maintains the amount of the City's
participation in this contract not to exceed $60,600.
