SUBJECT: Storage of Flammable and Combustible Liquids
Descrigtion•
A proposed ordinance amendment allowing the above-ground storage of flammable and
combustible liquids in the Industrial Park.
Background•
Under current city ordinance, the above-ground storage of flammable and combustible
liquids is prohibited within the City of Hastings. With rising fuel costs, large businesses
are researching ways to curb expenses relating to fuel costs. One option is to purchase
fuel in bulk, thereby receiving a reduced rate.
If approved, this above-ground storage shall prohibit the resale of product from these
tanks.
Requested Action:
Staff is recommending approving a first reading of a city ordinance allowing the storage
of flammable and combustible liquids in the Industrial Park and ordering a second
reading and a public hearing to be scheduled at the October 20, 2008, Hastings City
Council meeting.

93.04 Flammable and combustible liquid storage in above ground storage tanks.
(A) The storage of flammable and combustible liquids in above ground storage
tanks shall be limited to Industrial Park. This storage shall be for the sole purpose of fleet
fueling. The storage shall be limited to Class I, Class II and Class III liquids as described
in the Minnesota State Fire Code (MSFC). There shall be no resale of product from these
tanks.
(B) The installation and maintenance of above ground storage tanks, shall comply with
current editions of the Minnesota State Fire Code, National Fire Protection Agency
(NFPA), and Minnesota Pollution Control Agency rules and regulations.
(C) The maximum allowable storage capacity shall not exceed 10,000 gallons for Class II
and Class III liquids, 2000 gallons for Class I liquids.
(D) Installation of above ground storage tanks shall have approval of the fire chief and/or
the fire marshal.
(E) Afire code permit must be obtained through the office of the local fire marshal.
