Additionally, approve the first reading and order a public hearing and second reading for an ordinance relating to the fees associated with fireworks and pawn licenses. Background Information : In 2007, City staff consolidated the variety of fees charged for licenses, services, permits, rentals, inspections, and other city services into one fee schedule. The Council adopted the fee schedule in January 2008. The fees adopted in the 2008 schedule were the same fees that had previously been adopted by Council action, but in a different format. The objective of this consolidation was to provide for a more streamlined process to document adopted fees, and provide for an annual review of the fees charged. Some fees are required to be adopted by ordinance, which the City previously did. City Attorney Dan Fluegel has reviewed the schedule and recommends that the City adopt a comprehensive fee ordinance, which would codify our current adopted fees into ordinance. The current ordinance relating to fireworks and pawn licenses state that those fees will be adopted by resolution; the proposed change to that ordinance would ensure consistency with the rest of the City fees charged. At this time, no fee adjustments are being proposed. Staff will be reviewing the fee ordinance and will recommend changes later this year, likely as part of the 2010 budget preparation process. CITY OF HASTINGS, MINNESOTA ORDINANCE NO. ____, THIRD SERIES AN ORDINANCE OF THE CITY OF HASTINGS, MINNESOTA ADDING CHAPTER 34 OF THE HASTINGS CITY CODE PERTAINING TO FEES FOR LICENSES, PERMITS, RENTALS, LEASES AND MUNICIPAL SERVICES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: Chapter 34 of the Hastings City Code is hereby added as follows: Section 34.01 Fees Authorized and Defined. The fees for licenses, permits, rentals, leases and municipal services are in the amounts established in this section. Reference in other portions of this code or in other city ordinances to terms including, but not limited to “annual license fee”, “investigation fee”, “fee established by ordinance”, “required license fee”, “license fee,” or “appropriate fee” means the fees specified in this section. Section 34.02 Priority of Application. If fees are specified in other parts of this code or in other city ordinances but not in this section, then the fees specified shall be effective for all purposes. If there are amounts specified in this section as well as other chapters or ordinances, then the amounts appearing in this section supersede the others. Section 34.03 Fee Schedule. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: Chapter 110 of the Hastings City Code is hereby amended and § 110.11(E) (1) shall be deleted in its entirety and replaced as follows: (1) The annual license fees for each class of licenses issued under this section shall be established by ordinance resolution of the Hastings City Council. The annual license fee shall be payable semi-annually in accordance with procedures established by the City Council. Further, Chapter 113 of the Hastings City Code is hereby amended and § 113.11(C) shall be deleted in its entirety and replaced as follows: (C) License fees will be established by ordinance Council resolution.
