HomeMy WebLinkAboutVIII-21 Rescinding Assessment Appeal Waiver for SAC and WAC - 214 2nd Street E City Council Memorandum To: Mayor Fasbender and City Council From: Alex Menke, Economic Development Coordinator Date: December 16, 2024 Item: Approve Resolution to rescind Waiver Agreements Council Action Requested: Approve the attached Resolution to rescind Waiver Agreements that were previously approved by Council. A simple majority is necessary for action. Background Awful Gato Coffee, occupying the space at 214 2nd St E, applied for the Metropolitan Council and City of Hastings SAC/WAC Deferral Programs to convert 80% of their required SAC/WAC fees into a 10-year, low-interest loan. To collect payments, it was originally decided that the City would assess the property the amount and collect payments twice a year through the property taxes. These assessment waivers were approved by Council on October 7th and agreed to by the property owner, Marathon Properties of Hastings LLC. After further discussion, it was found that the method of collecting the payments would not be as efficient as previously thought. Staff has identified an easier method of collection that does not require assessing the property. Additionally, the original Assessment Waivers have not yet been recorded against the Property, allowing them to be rescinded and made null and void. Once rescinded, Staff will work with the business owner and property owner to set up the proper payment schedule. Attachments: - Resolution to Rescind Waiver Agreements VIII-21 RESOLUTION NO. _______ CITY OF HASTINGS DAKOTA COUNTY, MINNESOTA A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS RESCINDING OCTOBER 7, 2024 CITY COUNCIL ACTIONS RELATED TO 214 2ND ST. E. Council member ______ introduced the following Resolution and moved its adoption: WHEREAS, on October 7, 2024, the City Council took the following actions regarding 214 2nd St. E. and legally described as Mid 1/3 of Lot 2, Block 14, TOWN OF HASTINGS, Dakota County, Minnesota (the “Property”): 1. Approved the City of Hastings Assessment Appeal Waiver Agreement for 214 2nd Street East, Hastings, MN 55033 for Water Area Charges to assess Hastings Water Area Charges (“WAC”); and 2. Approved the City of Hastings Assessment Appeal Waiver Agreement for 214 2nd Street East, Hastings, MN 55033 for Sewer Accessibility Charges to assess Metropolitan Council Sewer Accessibility Charges (“SAC”); and WHEREAS, since those actions were taken, the City has determined that it no longer wants to proceed with a property tax assessment; and WHEREAS, the documents approved on October 7, 2024 were not recorded against the Property and the City Council may therefore rescind the above-mentioned actions, making the actions, approvals and documents null and void. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: The City Council hereby approves the Resolution as presented.
