A simple majority is required for action. Background Information: The applicant proposes to split the vacant lot into two lots for the construction of a twin home. both homes are proposed to be at grade entry level, handicap accessible, slab on grade, and roughly 1,000 – 1,200 Sq Ft each. The lot split will allow the units to be sold separately as opposed to the construction of a duplex on one lot. Please see the attached November 25, 2024 Planning Commission staff report for further information. Financial Impact: The new lot requires payment of the following: Sewer Interceptor: $485.00 Park Dedication: $3,200.00 Advisory Commission Discussion: The Planning Commission recommended approval of the request at their November 25, 2024 meeting (5-0). No comments were made at the public hearing. Staff received two calls in opposition to the proposal: 1. Randy Ficker – 1923 Eddy St – He is opposed to the property split; lot is too small to split. Concerned with a potential low income home. Should be one lot. 2. Phone Message – Did not leave name or number. Stated opposition to the duplex Council Committee Discussion: N\A Attachments: • Resolution • PC Staff Report - November 25, 2024 X-C-02 HASTINGS CITY COUNCIL RESOLUTION NO._________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS APPROVING A MINOR SUBDIVISION OF PROPERTY GENERALLY LOCATED AT 1915 EDDY STREET Council member ___________________________ introduced the following Resolution and moved its adoption: WHEREAS, Thomas Kane has initiated consideration of a minor subdivision on a 10,890 square foot property addressed as 1915 Eddy Street, legally described as Lot 17, AUDITORS SUBDIVISION NO 10, Dakota County Minnesota, and Subject to PAR 27 CITY OF HASTINGS R/W MAP NO 4; and WHEREAS, on November 25, 2024, a public hearing and review of this minor subdivision was held before the Planning Commission of the City of Hastings; and NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That the request to subdivide the property is hereby approved with the following conditions: 1. Survey of the property, consistent with the information provided in the Land Use Application and the Planning Commission Staff report dated November 25, 2024 2. Payment of $485.00 for sewer interceptor fee of one new lot. 3. Payment of $3,200.00 for park dedication fee of one new lot. 4. Any use or construction must comply with city ordinances and applicable fees. This action will create two separate lots. Background information: The former home on this lot was demolished in 1997 after fire damage. The applicant proposes to split the lot into two lots for the construction of a twin home. both homes are proposed to be at grade entry level and handicap accessible, slab on grade, and roughly 1,000 – 1,200 Sq Ft each. The lot split will allow the units to be sold separately as opposed to the construction of a duplex. The following requirements apply to the creation of an additional residential lot. - One Parkland Dedication Fee of $3,200 per unit (2024) - One Interceptor Sewer Fee of $485.00 Construction of a twin home requires an administrative building permit. At that time, a Certificate of Survey with grading plan is required to assure no additional drainage will flow to neighboring properties and setbacks are met (20’ front/ rear, 7’ sides). The following requirements apply to the construction of every residential unit. - WAC (Water Availability Charge) $2,957.00 - SAC (Sewer Availability Charge) $945.00 - One Boulevard tree per 50-feet of street frontage - One front yard tree per unit. - Units on separate lots must install their own service-lines to their mains. Comprehensive Plan Classification: The 2040 Comprehensive Plan designates the property as medium density residential. Zoning Classification: The property is zoned R-3, Medium-High Density Residence. There is an existing twin-home at 1908-A1 and A2, just north of the property across the street. That property was the same size in width but far deeper. Minor Subdivision Review The two proposed parcels meet the minimum lot size of 5,000 Sq Ft (5,445 Sf). This includes the property owned by the applicant but used by the city for Eddy Street with a roadway easement. Typically, that area is dedicated to the city as right of-way and no longer part of the property. Notification: Notification of the request was published and mailed to all property owners within 350 feet.
