Members Present: Mayor Fasbender, Councilmembers Fox, Haus, Lawrence, Leifeld, Pemble, and Vihrachoff Members Absent: None Staff Present: City Administrator Dan Wietecha Assistant City Administrator Kelly Murtaugh City Attorney Kori Land Community Development Director John Hinzman Public Works Director Ryan Stempski Approval of Minutes Mayor Fasbender asked if there were any additions or corrections to the minutes of the City Council workshop and regular meeting on November 4, 2024, and special meeting on November 12, 2024. Minutes were approved as presented. Consent Agenda Councilmember Haus motioned to approve the Consent Agenda removing item #7, seconded by Councilmember Fox. 7 Ayes, 0 Nays. 1. Pay Bills as Audited 2. Resolution No. 11-05-24: Accept Donation to Police Department from Walmart 3. Resolution No. 11-06-24: Accept Donations to Arts & Culture Commission 4. Authorize Signature: Sculpture Lease for Riverwalk 6. 1st Reading: Amend City Code Chapter 30 – Arts & Culture Commission 7. Certify Assessment of Delinquent Balances: Tree Removal/Treatment, Administrative Citations, and Abatements – Item Removed from Agenda 8. Certify Assessment of Delinquent Utility Bills 9. Authorize Signature: Hastings Civic Arena Ice Rental Agreement 10. Authorize Signature: Grant Agreement – Construction Grant for the Hastings City Hall Repair Project 11. Approve Pay Estimate No. 1 for the 2024 Sanitary Sewer Rehabilitations – Musson Bros. Inc. ($226,532.25) 12. Approve Pay Estimate No. 5 for the 2024 Neighborhood Infrastructure Improvements – A1 Excavating LLC ($448,400.98) 13. Resolution No. 11-08-24: Supporting and Authorizing Application to the MCES 2025 Private Property Inflow & Infiltration Grant City Council packets can be viewed in searchable format on the City’s website at http://www.hastingsmn.gov/city-government/city-council/city-council-agendas-and-minutes 1st Reading: Amend City Code Chapters 34.05, 95.98, 117, and 155 – Cannabis Regulations Attorney Land presented an overview of the proposed ordinance amendments regarding Cannabis Regulations. Land reviewed previous discussion regarding zoning districts, retail use and the anticipated license approval process from the Office of Cannabis Management, including the City registration process. There will also be a permit application and fee for special event organizer. The zoning ordinance addresses the various uses for a particular parcel. The uses include lower-potency, cannabis retail (dispensary), manufacturing/processing, and cultivation. Council discussion on cannabis retail buffer options presented by Land, with consensus around the option that puts 500’ buffers (except from commercial daycares, no park buffer for Downtown Core), stopping at Highways 55 and 61. Land reviewed the registration process for cannabis businesses. Council approval will be required for the registration of all cannabis and low-potency hemp edible businesses. The City’s registration term will follow the Office of Cannabis Management license period. Proposed ordinance language will cap a cannabis retailer at 1 per 12,500 population. Land reviewed the specifics of a Cannabis event permit, stating it must be approved by Council and must be on private property unless approved by Council to be on public property. Vendors at a special event may not seek a special event permit—the permit must be sought by the Special Event Organizer, who is to be licensed by the Office of Cannabis Management, following local permit approval. Land reviewed the proposed odor ordinance, which is not specific to the Cannabis ordinance, but complementary and would apply to any business in the City. Land proposed penalty fee of $10,000. Council discussion on odor detection technology. Council reached a consensus on the amount proposed for the odor violation penalty. Land provided clarification that the proposed odor ordinance applies to any business, not just cannabis businesses. Council expressed concerns about legislative changes and impact on Cannabis laws in the next session. Council action: Approve 1st reading of (1) cannabis and lower-potency hemp edible zoning ordinance amendment (with option 3); (2) amendment related to registration; (3) fee schedule amendment (adding penalty for odor violation), and (4) enactment of the odor ordinance. Councilmember Leifeld motioned to approve with consensus changes, seconded by Councilmember Haus. 7 Ayes, 0 Nays. Closed Meeting Pursuant to Minn. Stat. 13D.05, subd. 3(c) to Develop Offers for Purchase of Real Property Located at 1292 North Frontage Road Councilmember Leifeld motioned to move to the closed meeting, seconded by Councilmember Pemble. 7 Ayes, 0 Nays. Council discussed property acquisition for construction of the central (#2) Water Treatment Plant. Councilmember Leifeld motioned to close the closed meeting, seconded by Councilmember Lawrence. 7 Ayes, 0 Nays. Resolution No. 11-09-24: Approving Purchase Agreement for Property for a Water Treatment Plant from Jocor Holdings LLC Wietecha provided an overview of the request to approve the purchase agreement for property for Water Treatment Plant 2 from Jocor Holdings LLC. No Council discussion. Councilmember Leifeld motioned to approve as presented, seconded by Councilmember Fox. 7 Ayes, 0 Nays. Announcements • City Offices will be closed Thursday and Friday, November 28-29 in observation of Thanksgiving. • Gobble Gait is Thursday, November 28. You can register all the way up until race day. Residents can drop-off their unwanted light strands at the Joint Maintenance Facility, 920 – 10th Street West, during the holiday season from November 15 to January 31. • The Hastings Prescott Arts Council’s annual gala and silent auction is Sunday, December 8. You can attend in-person or online.
