Members Present: Mayor Fasbender, Councilmembers Fox, Haus, Lawrence, Leifeld, Pemble, and Vihrachoff Members Absent: None Staff Present: City Administrator Dan Wietecha Assistant City Administrator Kelly Murtaugh City Attorney Kori Land Community Development Director John Hinzman Public Works Director Ryan Stempski Proclamation: DARTS Appreciation Day Proclamation: LGBTQIA+ Pride Month Approval of Minutes Mayor Fasbender asked if there were any additions or corrections to the minutes of the City Council workshop and regular meeting on May 20, 2024. Minutes were approved as presented. Consent Agenda Councilmember Fox motioned to approve the Consent Agenda as presented, seconded by Councilmember Pemble. 7 Ayes, 0 Nays. 1. Pay Bills as Audited 2. Resolution No. 06-01-24: Accept Donation to the Parks and Recreation Department from the Rother Family 3. Resolution No. 06-02-24: Accept Donation to the Parks and Recreation Department from the Schommer Family Grandkids 4. Resolution No. 06-03-24: Approve New Cannabis Retail Sales License for Jake’s Discount Liquor & Wines 5. Water Service Repair Assessment Request – 526 Tiffany Drive 6. 1st Reading: Amend City Code Chapter 34 – Building Department Fees 7. Approve Sewer Lining Agreements – MCES Private I/I Grant Program 8. Authorize Signature: Use of Fire Safety House for Safety Camp on June 28, 2024 9. Authorize Signature: Use of Fire Safety House for Fire Department Open House on October 8, 2024 Mint Development – SW Corner of Pleasant Drive and South Frontage Road a. Resolution No. 06-04-24: Comprehensive Plan Amendment – Change Land Use District Designation from Medium Density Residential to Commercial b. 2nd Reading\Adopt Ordinance: Amend City Code Chapter 155.01 – Rezone Property from R-1 to C-4 City Council packets can be viewed in searchable format on the City’s website at http://www.hastingsmn.gov/city-government/city-council/city-council-agendas-and-minutes Hinzman provided a summary of the request to consider a Comprehensive Plan Amendment and Rezoning of the 3.94-acre property located at the SW Corner of Pleasant Drive and South Frontage Road. This request would change the future land use map designation of Medium Density Residential to Commercial and rezone the property from R-1 Low Density Residential to C-4 Regional Shopping Center. Hinzman indicated specific plans for development will be submitted at a later date but a conceptual plan has been shared to provide context on future development. Hinzman indicated a Purchase Agreement for sale of the property was executed by HEDRA and Mint Development on March 14, 2024 which included all land use approvals must be obtained prior to the December 31, 2024 deadline for closing. Council discussion on the dissenting vote from a Planning Commission member on the change of land use from Residential to Commercial. Hinzman provided an overview of the discussion on the rezoning request as the land abuts to residential properties. Council shared this development may help encourage other commercial developers to seek development opportunities in the area. Councilmember Fox motioned to approve as presented, seconded by Councilmember Vihrachoff. 7 Ayes, 0 Nays. 2nd Reading\Adopt Ordinance: Amend City Code Chapters 91 and 155 - Chickens, Ducks and Quails Hinzman provided an overview of the request to amend City Code Chapters 91 and 155 that would allow an increase in the number of chickens allowable and allow for the keeping of ducks and quail. Hinzman reviewed background information and Planning Commission discussion. The Planning Committee of City Council reviewed the topic and directed staff to draft an ordinance amendment. Council discussion on clarifying the combination and structures required. Hinzman indicated quails would require separate structures from chickens and ducks. Councilmember Leifeld amended the motion to allow license holders to be allowed to combine the keeping of chickens and ducks up to a total of six (6). Council discussion regarding complaints to date. Hinzman indicated the City has received complaints about residents not having proper licensure and an incident where chickens were roaming outside of the structure. Council confirmed ducks and chickens may only be female. Councilmember Leifeld motioned to approve as amended, seconded by Councilmember Fox. 7 Ayes, 0 Nays. PFAS Update As it is the first meeting of the month, Wietecha presented the PFAS Update. Wietecha reviewed key updates in funding applications at the state and federal levels, as well as providing an update on the submission of the City’s PFAS Treatment & Raw Water Lines for consideration in the State’s 2024 Capital Budget. Council discussion on reconsideration of a residential neighborhood as a site for a utility of this kind and requests that all possible sites be considered. Residential Solid Waste & Recycling Contract City Council packets can be viewed in searchable format on the City’s website at http://www.hastingsmn.gov/city-government/city-council/city-council-agendas-and-minutes Wietecha provided an overview of the request to extend the residential solid waste collection contract with Tennis Sanitation. Wietecha shared the City has contracted with Tennis Sanitation since 2013 for exclusive residential solid waste collection. The base three-year contract ran from January 2019 through December 2021. Wietecha indicated the contract was extended in 2021 through December 2024. Wietecha reviewed Utility Committee discussions, sharing the committee recommendation to approve the second contract extension that will run January 2025 – December 2027. Council discussion about price and service provided by Tennis Sanitation as well as low number of complaints. Council expressed appreciation for the strong customer service and support for City events. Councilmember Pemble motioned to approve as presented, seconded by Councilmember Leifeld. 7 Ayes, 0 Nays. Announcements • Pride Event on Saturday, June 8. Event begins at 11 am at Kennedy Elementary parking and heads to Levee Park for the Festivities. • Coffee with a Cop is Tuesday, June 4, from 10 – noon at Coborn’s Caribou Coffee. Join the police to ask questions, voice concerns, and get to know one another. • On Tuesday, June 4, join us for the Summer Kick-Off to our 2024 Levee Park Events – free entertainment, interactive motorized race course, bouncer, climbing wall, caricature artists, balloon artist, and more. All ages are welcome to this free event. • Summer Rec Programs at Levee Park… o Thursday, June 6, Music in the Park with “The Sidekicks – Tribute to the 80’s.” Supported by the Ruth and George Doffing Charitable Fund. o Thursday, June 13, Music in the Park with “allegations – Tribute to the Blues.” Supported by the Ruth and George Doffing Charitable Fund. o Friday, June 14, Movies in the Park with “Elemental.” Sponsored by Ardent Mills. Please bring a non-perishable food donation. o Saturday, June 15, Bike with a Ranger on a guided tour of the 10 Mile Loop. Pre-registration required for this free event. • The City’s Parks & Recreation and Police Departments are partnering with Hastings Prescott Arts Council to serve up fun for youth in Hastings. The Rec + Art + Police program will offer free activities, treats, and giveaways this summer. The first event is Wednesday, June 12, from 1 to 2 pm at Levee Park with straw weaving, DJ, and contests. Recommended for elementary and middle schoolers. Supported by SC Toys, Country Financial, Hastings Lions Club, Hastings Family Service, and Community Ed. • Makers Market will be in Levee Park on Thursday, June 13. Support area makers and artisans within our historic downtown and riverfront park by shopping at the markets. • Happy Birthday last week to Councilmember Tim Lawrence. • Animal Ark Annual 3K Walk on Saturday, June 8th.
